These Terms of Service (“Terms”) govern the use of services provided by MB MDV Solutions, company code 307028286 (“we”, “provider”) under the RADOU DAROU brand – including orienteering games, events, rental or licensed use of the technical solution for the game, consultations and related services – and the use of our website radoudarou.lt. By using the website or ordering services you confirm that you have read and agree to these Terms.
1. Application of the Terms
These Terms apply to all visitors, customers and event participants. If an order is placed on behalf of a company or organisation, the person placing it confirms they have authority to bind that entity. If you do not agree to the Terms, please do not use the website or order services.
2. Services
We provide orienteering games and related events on request or as public events. We also provide the technical solution for the game (digital platform, software and related equipment or access) as a use and/or rental service under the contract, order or event / offer terms. Specific content, duration, location, price, manner of providing the technical solution and other conditions are set out in the contract, order confirmation or event description. We may refuse an order for objective reasons (e.g. force majeure, safety) or suggest an alternative.
3. Events and acceptance of rules
By participating in our events and/or using the game flow, equipment or venue, you agree to follow the event and game rules set by the organisers, safety requirements and instructions from organisers or authorised staff. Rules may be provided before the event, at the venue or in a digital application. Serious or repeated breaches may result in removal from the event without refund where justified by safety or other material reasons.
4. Orders, pricing and payment
Prices are shown before you order or as set out in a quote. Payment is processed according to the method you choose (payment provider terms apply). If cancellation or refunds are governed by a separate policy or event rules, those provisions apply in addition.
5. Conduct, health and legal responsibility
Participants must behave responsibly, not harm others, comply with applicable laws and not disrupt the event. Participants bear full responsibility for their own health, fitness and decision to take part, and for their own conduct and any infringement of third-party rights or public order during the event or when using the technical solution. We do not accept liability for participants’ health, injuries, incidents or legal infringements caused by participants’ actions, except where mandatory law expressly provides otherwise. Supervision of children or vulnerable persons remains with parents, guardians or accompanying adults where applicable.
6. Intellectual property
Game scenarios, trademarks, website content, software and materials are protected by copyright and other intellectual property rights. Copying, distribution or commercial use without written permission is prohibited except as permitted by law.
7. Limitation of liability
We provide services professionally and in accordance with the agreement. To the extent permitted by law, we are not liable for indirect losses, lost profits or third-party actions. We expressly limit our liability for participants’ health, the conduct of participants or other persons and any legal infringements related to the event or use of the technical solution – such liability rests with the participants or other relevant persons, except where mandatory law expressly provides otherwise. Where the law does not permit a limitation, only the minimum extent permitted by law applies.
8. Personal data
We process personal data in line with our Privacy Policy, which should be read together with these Terms for information on how we handle your data. The Privacy Policy is available on the website.
9. Changes to the Terms
We may amend these Terms. The updated version is published on the website with a new date. Continued use of the services after changes may constitute acceptance of the new version, unless mandatory law requires otherwise.
10. Governing law and disputes
These Terms are governed by the law of the Republic of Lithuania. We aim to resolve disputes amicably. If that fails, disputes shall be resolved in the courts of the Republic of Lithuania in accordance with applicable procedural rules.
